The function of the Transport Tribunal is to review the decisions of the Commissioner for Transport in respect of applications made under Section 33(1), 77D(3), 88D(3), 88L(3), 91(1) and 102C(3) of the Road Traffic Ordinance (Cap. 374), Regulation 45 of the Road Traffic (Driving Licences) Regulations (Cap. 374B) and Regulations 8 and 23 of the Road Traffic (Public Service Vehicles) Regulations (Cap. 374D). The Transport Tribunal is empowered: |

(a) |
to review a decision of the Commissioner for Transport to refuse to register or license a vehicle or to cancel a licence; |
|
|
(b) |
to review a decision of the Commissioner for Transport to refuse to issue a passenger service licence, or to cancel, suspend or vary the terms of a passenger service licence; |
|
|
(c) |
to review a decision of the Commissioner for Transport to revoke the designation of a vehicle emission testing centre; |
|
|
(d) |
to review a decision of the Commissioner for Transport to revoke the designation of a car testing centre; |
|
|
(e) |
to review a decision of the Commissioner for Transport to revoke the designation of a driving school; |
|
|
(f) |
to review a decision of the Commissioner for Transport on suspension of vehicle licence on the conviction of a driver; |
|
|
(g) |
to review a decision of the Commissioner for Transport to revoke the designation of a driving improvement school; |
|
|
(h) |
to review a decision of the Commissioner for Transport to refuse to issue, re-issue or renew a driving licence or driving instructor's licence, or to cancel a driving licence or driving instructor's licence; |
|
|
(i) |
to review a decision of the Commissioner for Transport to amend the terms or conditions of a passenger service licence; |
|
|
(j) |
to review a decision of the Commissioner for Transport to cancel a hire car permit, to refuse to issue a hire car permit, or to specify any conditions in a hire car permit. |

2. |
The Transport Tribunal comprises an unofficial chairman and two unofficial members (drawn from the respective panel) as provided for under Section 17 of Road Traffic Ordinance, Cap. 374. |

The powers of the Transport Tribunal are governed by section 19 of Road Traffic Ordinance, Cap. 374 whereas the rules of practice and procedure in any hearing before the Transport Tribunal are prescribed by section 20 of Road Traffic Ordinance, Cap. 374. |

In 2009, the Transport Tribunal processed 62 applications. These applications were related to the review of the decision of the Commissioner for Transport for : |

(a) |
suspension or cancellation of passenger service licence, |
|
|
(b) |
cancellation of driving licence, and |
|
|
(c) |
refusal to issue driving licence. |
