Kaito ferry service is the licensed ferry service approved by the Commissioner for Transport ("Commissioner") under Section 28 of the Ferry Services Ordinance (Cap. 104) ("Ordinance"). According to Section 2 of the Ordinance, ferry service means a service provided by means of a vessel, for the conveyance by water of passengers, baggage, goods or vehicles, for reward at separate fares between 2 or more points within the waters of Hong Kong.
To operate Kaito ferry service, one must hold the Kaito Ferry Service Licence issued by the Transport Department. According to Section 4(1) of the Ordinance, no person shall operate or permit the operation of a vessel on a ferry service (other than those ferry services exempted under Section 5 of the Ordinance) except under a franchise or a licence. In addition, pursuant to Section 4(2) of the Ordinance, no person shall operate or manage or assist in the management of a ferry service other than those exempted under Section 5 of the Ordinance unless that service is operated under a franchise or licence.
